These bills would rescind the Bona Fide Place of Business requirement for 8(a) construction contracts. House NDAA Amendment 1374 - CONSIDERATION OF PAST PERFORMANCE OF AFFILIATES OF SMALL BUSINESS CONCERNS. Senate NDAA Provision - SEC. 843. CONSIDERATION OF THE PAST PERFORMANCE OF AFFILIATE COMPANIES OF SMALL BUSINESSES. This legislation would require past performance consideration for affiliate companies when bidding on DoD contracts.
